| NO PURCHASE IS NECESSARY TO ENTER OR WIN. Void in New Jersey, U.S. possessions, territories, overseas military installations in foreign countries and outside of the 50 United States, DC and where prohibited by law. Subject to all federal, state, and local laws, regulations, and ordinances. Sweepstakes begins at 11:59 PM Pacific Standard Time (“PST") on January 23, 2012 and ends at 11:59 PM PST on January 22, 2014 (the "Sweepstakes Period").
This Sweepstakes is sponsored by R. M. Hamilton Golf, 231 Camino Toluca, Camarillo, CA 93010 (RMH or “Sponsor”).
1)ELIGIBILITY: The "Win Hawaii Golf" Sweepstakes (the "Sweepstakes") is open only to legal U.S. residents currently residing in the fifty (50) United States and the District of Columbia (excluding New Jersey, U.S. possessions, territories, overseas military installations in foreign countries and Puerto Rico) who are at least 18 years of age or the age of majority in their jurisdiction of primary residence as of January 24, 2012. Employees, officers and directors of R. M. Hamilton Golf, and any of its parents, subsidiaries, affiliates, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment, and marketing agencies, web site providers, web masters, and members of their immediate families (spouses, parents, siblings and children, regardless of where they live) and those living in the same household are not eligible to win. All participants must have access to the Internet prior to the start of the Sweepstakes. Sponsor reserves the right to verify the eligibility of winners. Participation constitutes participant's full and unconditional agreement to these Official Rules and to Sponsor's decisions, which are final and binding in all matters related to the Sweepstakes.
2)TO ENTER: During the Sweepstakes Period, you will automatically be entered to win the grand prize of a trip for four to Hawaii. Each purchase constitutes an entry. You may also win by mailing a 3 x 5”, hand written card with your name and address, phone number, email address in a number 10 envelope to R. M. Hamilton Golf, 231 Camino Toluca, Camarillo, California 93010, attn; Sweepstakes entry. One entry per envelope, one per day. You must provide all required information on the Official Entry Form, including without limitation, first and last name, address, city, state, zip, phone number, confirmation you are a minimum of 18 years of age or the age of majority in your jurisdiction of residence and email address, to be eligible to enter. Entries must be submitted by the participant. All entrants agree that Sponsor and Sponsor's agent, affiliates or service providers may use entrants' personal information submitted with the entry for purposes of prize fulfillment and /or for future marketing by Sponsor, such as to notify them of a product or promotion that Sponsor thinks may be of interest. Any attempt by any participant to obtain more than the permitted number of entries by using multiple and/or different identities, forms, registrations, addresses or any other method will void all of that participant's entries and that participant may be disqualified at Sponsor's discretion. Multiple participants are not permitted to share the same email address. Bulk entries, entries submitted by third parties, mechanically reproduced or photocopied entries, or entries created using automation or computer programs are prohibited and automatically void.
3)SELECTION OF WINNERS/WINNER NOTIFICATION: On or about February 14, 2014, the potential Grand Prize winner will be selected in a random drawing from among all eligible entries received during the Sweepstakes Period. Odds of winning the Grand Prize depend on the total number of eligible entries received by the end of the Sweepstakes Period.
Grand Prize winners will be notified by mail, email and/or phone. Except where prohibited, the potential Grand Prize winners will be required to complete and return an affidavit of eligibility, liability/publicity release (the "Affidavit/Release") within ten (10) days of being notified. If a potential winner fails to sign and return the Affidavit/Release within the required time period, or is unavailable to accept the prize within the time period specified by Sponsor, the potential winner will be deemed to have forfeited the prize, and an alternate potential winner will be selected. If a prize or prize notification is returned as non-deliverable, or if a potential winner does not respond to prize notification or if any potential winner does not comply with these Official Rules, then the potential winner may be disqualified and an alternate potential winner will be selected. Noncompliance with the foregoing, failure to abide by these Official Rules, or return of the prize notification as non-deliverable may result in disqualification and naming of an alternate potential winner. Up to (4) alternate winners will be selected, after which the prize will remain un-awarded.
POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES. AN PARTICIPANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL PARTICIPANT'S ELIGIBILITY HAS BEEN VERIFIED AND PARTICIPANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.
4)PRIZES AND APPROXIMATE RETAIL VALUE ("ARV"): Grand Prize: One (1) Grand Prize will be awarded, which consists of a 5-day/4-night stay for four, 2 rounds of golf for each person, at a luxuary hotel chossen by the sponsor. Approximate Retail Value ("ARV") of the Grand Prize: $2,500.00.
5)PRIZE RESTRICTIONS: Any and all applicable federal, state, and local taxes and all fees and expenses related to acceptance and use of prize not specifically stated herein are the responsibility solely of the winners. Grand Prize Winners will be issued a 1099 tax form for the appropriate retail value of the prize. Prizes cannot be substituted, assigned, transferred, or redeemed for cash; however, Sponsor reserves the right to make equivalent prize substitutions at its sole discretion if any advertised prize (or portion of a prize) becomes unavailable. Sponsor will not replace any lost or stolen prizes. Prize cannot be used in conjunction with any other promotion or offer. Grand Prize must be used by December 15, 2015. Certain restrictions and blackout dates apply. Major credit card required at check-in to cover any incidental charges. Only the number of prizes stated in these Official Rules is available to be won in the Sweepstakes. Accommodations are in either a garden, mountain, or resort view. View is determined by the Sponsor.
Sponsor shall have no liability for any personal injuries, death, property damage, or other damages or expenses resulting from or arising out of any travel related to ANY GRAND Prize or any other aspect of ANY Prize Winner's acceptance or use of ANY Prize.
6)GENERAL CONDITIONS: This Sweepstakes is governed by the laws of the United States. Void in New Jersey, U.S. possessions, territories, overseas military installations in foreign countries and outside the 50 United States and DC and where prohibited. WARNING: ANY ATTEMPT BY AN PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE ASSOCIATED WITH THIS SWEEPSTAKES OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Neither Sponsor nor anyone acting on its behalf will enter into any communications with any participant regarding this Sweepstakes, except as expressly set forth in these Official Rules. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be attempting to tamper with or undermine the entry/Application process, the web site, and/or the legitimate operation of the Sweepstakes; to violate the Official Rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person. Sponsor and its agents are not responsible for (1) any incorrect or inaccurate information, whether caused by participants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from participant's participation in the Sweepstakes or receipt or use or misuse of any prize. If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus or bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor, which corrupt or affect the operation, administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor may, in its sole discretion, void any suspect entries and (a) cancel or terminate the Sweepstakes; (b) modify the Sweepstakes or suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; or (c) award the applicable prizes at random from among the eligible, non-suspect entries received up to the time of the impairment.
7)LIMITATIONS OF LIABILITY AND RELEASES: BY PARTICIPATING IN THIS SWEEPSTAKES, PARTICIPANTS AGREE THAT SPONSOR, AND THEIR RESPECTIVE PARENTS, AFFILIATES, FRANCHISEES, SUBSIDIARIES, REPRESENTATIVES, CONSULTANTS, CONTRACTORS, LEGAL COUNSEL, ADVERTISING, PUBLIC RELATIONS, PROMOTIONAL, FULFILLMENT AND MARKETING, WEB SITE PROVIDERS, WEB MASTERS, AND ADMINISTRATOR, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AGENTS (THE "RELEASED PARTIES") WILL HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY PARTICIPANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE, OR USE OF THE PRIZE, ENTRY, OR PARTICIPATION IN THIS SWEEPSTAKES OR IN ANY SWEEPSTAKES RELATED ACTIVITY, OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY, OR MERCHANDISE DELIVERY. EXCEPT WHERE PROHIBITED BY LAW, PARTICIPATION IN THE SWEEPSTAKES CONSTITUTES WINNER'S GRANT TO SPONSOR, AND THE RELEASED PARTIES THE RIGHT AND PERMISSION TO PRINT, PUBLISH, BROADCAST, AND USE, WORLDWIDE IN ANY MEDIA NOW KNOWN OR HEREAFTER DEVELOPED, INCLUDING BUT NOT LIMITED TO THE WORLD WIDE WEB, AT ANY TIME OR TIMES, THE WINNER'S NAME, PORTRAIT, PICTURE, VOICE, LIKENESS, OPINIONS AND BIOGRAPHICAL INFORMATION (INCLUDING BUT NOT LIMITED TO HOMETOWN AND STATE) FOR ADVERTISING, TRADE, AND PROMOTIONAL PURPOSES (INCLUDING THE ANNOUNCEMENT OF HIS OR HER NAME ON TELEVISION OR RADIO BROADCAST) WITHOUT ADDITIONAL CONSIDERATION, COMPENSATION, PERMISSION, OR NOTIFICATION.
WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS SWEEPSTAKES, INCLUDING THE WEB SITE AND ALL PRIZES, ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY. CHECK LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
8)DISPUTES: Except where prohibited and subject to applicable law, participant agrees that: any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the District of California or the appropriate California State Court located in California in the U.S.; (2) any and all claims, judgment, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorneys' fees; (3) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law |
